Legal requirements

There are a number of legal requirements under the Marriage Act 1961 that a couple intending to marry must meet prior to a marriage ceremony being solemnised.

Major requirements

These include:

Completion of the Notice of Intended Marriage (NIM) form at the very latest one month before the wedding date
Both partners are required to sign a declaration stating that you believe there is no legal impediment to the marriage between yourself and your partner.
Both partners must be over the age of 18.
Sighting of original Birth Certificate (if you were born in Australia).
If born outside Australia a birth certificate is also required; however, in the absence of that document, you may produce your overseas Passport.
In the event of a previous marriage, either a copy of the Decree Absolute or Death Certificate must be produced.
Two witnesses over the age of 18 and who are present at the ceremony are required to sign marriage documentation.
